Privacy notice

BRAUFORT S.C., a Mexican partnership (sociedad civil), is the controller of personal information collected through this website and the Prueba de Uso platform. We operate from Mexico.

Prueba de Uso is a technology platform for creating, preserving, and digitally sealing records of trademark use. It is not a law firm and does not provide individualized legal advice.

We collect information needed to provide and operate the service, including:

  • Contact information, such as your name, email address, and phone number.
  • Trademark information, such as the mark name, application or registration details, classes, owner, and relevant dates. You may enter it, or it may come from publicly available IMPI records.
  • Billing information needed for invoices, such as tax ID, legal name, Mexican tax classification, postal code, and the invoice’s designated tax purpose (uso del CFDI).
  • Payment information. Stripe handles card payments; we do not store complete card details.
  • Technical and usage information, such as IP address, browser and operating system, pages visited, and session logs.

We use personal information to:

  • Create, preserve, and digitally seal trademark-use evidence that you submit.
  • Monitor declaration-of-use and renewal dates associated with your trademarks.
  • Manage your account, subscription, payments, and invoices.
  • Maintain platform security, diagnose errors, and provide support.
  • Send service or promotional communications when you have given the required consent. You may withdraw that consent at any time.

You choose whether submitted evidence is visible in the online catalog that visitors can inspect. A published record may show the sealed evidence, trademark name, class, and sealing date.

The owner name, tax ID, or address is published only with your express permission. You can choose private visibility for submitted evidence.

Essential cookies support authentication, account security, and site preferences. On this English-language page, when the relevant services are enabled, analytics and advertising measurement tags may also run. These may include Google Analytics, Google Ads, Meta, TikTok, and LinkedIn.

If you visit us from the European Union, the European Economic Area, the United Kingdom or Switzerland, we only turn these cookies on if you accept them.

A first-party attribution cookie can remember how you arrived at the site. It is kept for 90 days. You can block or delete cookies in your browser settings and manage advertising choices through the settings offered by the relevant providers.

We share only information needed for the service with providers that help us operate it:

  • Stripe, in the United States, processes payments.
  • Sentry, in the United States, monitors technical errors.
  • Hosting providers may process information outside Mexico.
  • Electronic invoicing and timestamping providers process relevant information in Mexico.

Your information is processed in Mexico and the United States. The service providers described above may process information in those countries.

We do not sell personal information.

We keep trademark-use evidence while your account is active and for 30 calendar days after account closure. We keep tax records for the periods required by applicable law.

Evidence connected to an active proceeding before the Mexican Institute of Industrial Property (IMPI) is kept until that proceeding ends. You can download account evidence during the 30 days after account closure.

You may request access to, correction of, or deletion of your personal information by emailing privacidad@pruebadeuso.com. We respond within 20 business days.

Evidence connected to an active IMPI proceeding remains in place until the proceeding ends.

The platform is intended for adults aged 18 or older. We do not knowingly collect personal information from children.

We use administrative, physical, and technical safeguards, including access controls and encryption, to protect information. No online service can eliminate every security risk.

For a material change, we will email account holders at least 10 days before the change takes effect.
